A lawsuit has been filed in Pulaski County Circuit Court against Zaxby's Franchising, LLC, DND Groups, Inc., and Zaxby's Operating Company, LP. The legal action, initiated by Potts Law Firm, represents a minor identified as S.H., who alleges she was sexually assaulted by her manager while employed at a Zaxby's Chicken Fingers & Buffalo Wings restaurant in Sherwood, Arkansas.

The manager, who was 39 years old at the time of the alleged incidents, is accused of coercing the minor into sexual acts during April and May 2025. He faces five felony charges, including two counts of first-degree sexual assault and multiple counts of sexual indecency with a child.

The lawsuit alleges that Zaxby's corporate entities and franchise operators were aware of the manager's criminal history and prior misconduct but failed to take adequate measures to protect their employees. The filing includes allegations of negligent hiring, supervision, and retention, as well as premises liability and intentional infliction of emotional distress. The complaint argues that the manager's criminal background should have precluded him from supervising minors.

The plaintiff is seeking compensatory and punitive damages for emotional distress, pain and suffering, and related medical and mental health expenses. A jury trial has been requested for the case, titled Armstrong v. Zaxby's Franchising, LLC; Cause No. 60CV-25-13586, which will be heard in the Circuit Court for Pulaski County.

The legal proceedings highlight ongoing concerns about corporate responsibility and employee safety within franchise operations. The outcome of this case may have implications for how companies address hiring practices and oversight of employees with criminal backgrounds.
